Motion to Dismiss Granted in District Court
A motion to dismiss without prejudice was addressed recently in Fourth Judicial District Court in Sheridan. Sheridan Media’s Ron Richter has the details.
During the hearing in District Court for Adam Godwin, who was charged with two counts of drug distribution, Sheridan County Attorney Dianna Bennett said she filed the motion to dismiss without prejudice at the request of the Bureau of Alcohol, Tobacco, Firearms and Explosives. The motion to dismiss was granted by District Court Judge John Fenn.
In April Godwin was arrested and charged with one count of Possession of a Controlled Substance With Intent to Deliver- Methamphetamine and one count of Possession of a Controlled Substance With Intent to Deliver- Marijuana. Bennett said the ATF wanted the case dismissed as they intend to pursue the case because a firearm was involved and Godwin is a convicted felon. Godwin was sentenced to 3 to 5 years in prison in May for a burglary charge.

Here’s a thought….
Instead of throwing as many charges at a person as they can hoping 1 will stick. How about dialing out the .gov racketeering efforts and focus on legitimate needs & reasonings involved and in drug related crimes.
Rather then potentially ruining the rest of someone’s life & lives of those involved with them. Why not shift the focus to the person’s motivations and pre-existing circumstances. Come up with a solution based approach to meet the individual’s needs in the direction of corrective learning and prevention of the potential for repeat offenses.
Simply imprisoning people teaches them nothing but hate. If we truly strive for a safer society we need to encompass all it’s aspects and take a cognitive look at what we call correctional facilities…
By definition nothing is being
” corrected ” under current practices and standards. We are all children of this universe.
Some have more trouble learning then others for a variety of reasons.
As with teaching youth when they have difficulties, the same firm nuruting nature can make just as big a difference to adults in need of giudence & personal concern for their long term functionality.
Care & direction in place of captivity and deprivation.
