Wyoming Attorney General Attempting To Take State Abortion Issue To Supreme Court

Wyoming’s attorney general’s office wants the state Supreme Court to take on a lower court lawsuit contesting a state ban on abortion in nearly all cases.

The office on Thursday (August 18th) filed a motion with Teton County District Court Judge Melissa Owens to let the state ask the Supreme Court to accept the case in hopes of expediting its resolution.

The law banning abortion in most cases briefly took effect July 27, but Owens has issued orders suspending the law while the lawsuit proceeds, finding the law would harm pregnant women and their doctors and that constitutional questions need to be answered.

Owens is set to consider the state’s motion at an Aug. 24 hearing.

The Wyoming law would ban abortion except in cases of rape or incest or to protect the mother’s life or health, not including psychological condition.

Those who violate the ban would be charged with a felony punishable by up to 14 years in prison.

Gov. Mark Gordon, a Republican, signed the “trigger” ban into law in March.

The law was written to take effect if the U.S. Supreme Court overturned the Roe v. Wade decision, which happened June 24th.

“The question at the heart of this case is whether the Wyoming Constitution confers a right to abortion, either explicitly or implicitly,” reads the filing by Special Assistant Attorney General Jay Jerde.

Four women, including two obstetricians, and two nonprofits, including a planned Casper women’s health care and abortion clinic that was firebombed in May, have sued to contest the law.

The plaintiffs say the bill violates a multitude of rights afforded to them in the state Constitution, including their right to privacy and the right to make their own health care decisions.

    …the radical republican agenda…the attack of abortion rights for women is rearing its ugly head Republicans balked in mass when told to wear facemasks during the pandemic…point is the GOP doesn’t like to be told what to do (wear facemasks) …but like to tell everyone what to do with regard to abortion rights…and what affect do you think abortion bans will have on the taxpayer payout for welfare rolls to subsidize mothers or families that will be forced to term pregnancies who can’t afford more children?…the GOP is in for “sticker shock” when they get the price tag for not only the hospital bills but for welfare payments and we all know how the GOP feels about entitlements…the GOP has a very radical agenda and voter opposition in the voting booth is the only thing that will stop the radical republican agenda in its tracks

      Ah…. you are consistently wrong. The right to kill/murder an innocent person is not a ‘right’. It is not a constitutional right–its not in the document. If you dont know it there is a big difference that wearing a facemask or not and murdering a baby. Tell me, during an abortion which heart stops–the mom or baby? You talk of cost. How can you put a price tag on the life of an unborn yet living child??? Are you saying it is more cost effective to kill it?? does that apply to our elderly? How bout to you when you are elderly? Your arguments are pathetic and i am embarrassed for you. I will oppose people like you every step of the way and be assured i am not the defenseless child in the womb to be destroyed by weak minded and selfish people….

            …many child bearing age couples are having difficult decisions whether to have a first child or another child because of the cost it takes to raise kids these days…it costs hundreds of thousands of dollars to raise kids…pro choice that’s what people desire in life….choices…simple…

            …if governor gordon and the legislature wish to push their agenda “choices” then the taxpayers will need to step up to the plate to subsidize increased welfare rolls in Wyoming…if that’s the governors and the legislatures “choice”…simple…
