Montana Woman Fails to Appear for Sentencing

A defendant who was supposed to be sentenced this week in Fourth Judicial District Court in Sheridan failed to appear for the hearing. Sheridan Media’s Ron Richter has the details.
In early November of last year, 31-year-old Brandi Davitt of Roundup, Montana changed her plea to “guilty” to the charge of Unlawful Possession of a Controlled Substance- Amphetamine. The plea agreement reached with the State recommended a sentence of 2 to 5 years in prison, suspended in lieu of three years of supervised probation. An additional charge of marijuana possession was dismissed as part of the plea deal. Davitt failed to show for her scheduled sentencing hearing on January 12, and was also a no show for the rescheduled hearing on Tuesday.
Davitt’s Public Defender, Anna Malmberg said she has made several unsuccessful attempts to reach Davitt by phone. District Court Judge John Fenn said a bench warrant that was issued for her arrest in January will remain active and sentencing would be scheduled once Davitt is arrested and taken into custody. Davitt was charged with the crimes last year on May 6 when she was a passenger in a vehicle that had been pulled over by law enforcement for a traffic violation in Sheridan County. A subsequent search of the vehicle found Davitt to be in possession of amphetamine and marijuana, and she was placed under arrest. Davitt has five previous convictions for drug possession.
