Montana Woman Changes Plea on Drug Charge in District Court

A virtual change of plea hearing was held Thursday in Fourth Judicial District Court in Sheridan for a 31-year-old woman from Roundup, Montana. Sheridan Media’s Ron Richter has the details.

Change of Plea


On May 6 of this year, Brandi Davitt was a passenger in a vehicle that had been pulled over by law enforcement for a traffic violation in Sheridan County. A subsequent search of the vehicle found Davitt to be in possession of amphetamine and marijuana, and she was placed under arrest. Pursuant to terms of a plea agreement reached with the state, Davitt, at a hearing Thursday,  pleaded guilty to the charge of Unlawful Possession of a Controlled Substance- Amphetamine. In exchange for the guilty plea, the state dismissed a charge of marijuana possession.

The plea deal recommends a sentence of 2 to 5 years in prison, suspended in lieu of three years of supervised probation. Davitt has five previous convictions for drug possession. District Court Judge John Fenn ordered that a presentence investigation be completed and set the date for sentencing for January 12 at 11 am.
