Johnson County Takes No Action on Proposed Quarry

The Johnson County Commission has decided to not get involved in a dispute over a proposed quarry in a county subdivision and allow homeowners in the subdivision to resolve the issue themselves.

County Planner Jim Waller brought the issue before the commission at their most recent meeting, saying he had been approached by some homeowners in the subdivision asking the county to restrict or not allow the proposed quarry.

The proposed quarry is off of Airport Road in the Tuff Acres Subdivision, according to discussions at the meeting.

County Attorney Tucker Ruby said his opinion is that the county’s position is, even though the subdivision covenants may say the county can and must approve changes, to not enforce covenants.

The commission’s decision was to let the homeowners in the subdivision decide how to act on and/or enforce the existing covenants.
