County Approves Amended Certificate

Johnson County’s Commissioners reviewed and approved an amended certificate to correct the county record, brought by County Attorney Tucker Ruby.

Ruby said there was an agreement between the county and a landowner in the 1970s that essentially showed ownership of lands by the county, which would allow the county to operate a gravel pit on the lands, but with the stipulation that once the county no longer used the pit, ownership would revert to the original landowner.

The paperwork was never filed and ownership is still shown as Johnson County.

Ruby said the current owner of the lands filed a Petition for Amended Certificate to correct the problem.

Ruby brought a Quitclaim Deed, which will negate any interest the county may have and put the petition back in the hands of the property owner to clean up the remainder of the paperwork on the property.

The Quitclaim Deed was approved by the commission for Chairman Bill Novotny to sign.
