The Board should get all its business done, while it’s still a 5-member Board.
The case for willful dereliction of duty is very strong!
And since they all “stuck to their story” the only thing to save them now, is a heart-felt apology, contrition and resignation.
And if the person most responsible for this fiasco (the chair) comes forward before the Judge rules….she may be able to, at least, save some of her fellow conspirators.
The captain must go down with the ship…but she doesn’t have to take the others down with her. It’s known as Honor. It’s called Integrity.

It is clear that all four commissioners Failed to do their job. All they had to do was pick 1 out of 3 nominees to fill the vacancy. They Failed and it had to go to a judge. They used the wrong voting procedure and the only real question is: Why?
Did the Four willfully intend to Fail? Or did they, thru either neglect or sheer stupidity, use the wrong voting procedure?
Why is every commission composed of an odd # of folks? To prevent a tie vote. Going into the meeting to select a replacement, there were Four voting commissioners. Since an even number of voters has the potential of deadlocking in a tie-vote, the commissioners should have chosen a procedure that would preclude a tie. That procedure is clearly spelled out in Robert’s Rules. The chair-person abstains and the three then vote. Most times it’s a 2-1 vote. Had that happened, the most vote-getting nominee is selected to fill the seat. Seat filled, Job done. In the rare case of a 1-1-1 Tie vote, the chair then steps in to break the tie. 2-1-1 vote, vacancy filled job done. It’s rock, paper, scissors and basic rules of government, that most high school kids know. I think the evidence is overwhelming that the Four commissioners deliberately went into the meeting with an intent to Fail. If they chose the wrong voting method in order fail, then they are guilty of not only failing to do their statutory duties, but conspiracy to circumvent the Law. And they should be removed and charged. If they failed out of neglect or stupidity, one or more should be removed for failing to do their due diligence. Bottom Line: They Failed the good People of Sheridan County and a Judge had to step in and do their job. That’s a fact.
