Ron RichterBender Lane in Sheridan is located just west of Sheridan Avenue, immediately after crossing Little Goose Creek if traveling south on Sheridan Avenue. City Attorney Brendon Kerns said the lane is the main access point for five property owners on approximately 12.5 acres and of those properties, about 10 acres cannot be developed without resolving the legal access of Bender Lane.
Kerns, while addressing the Sheridan City Council and Mayor Rich Bridger at a recent council study session, said a quiet title action needs to be filed.
Kerns said the matter will require a court ruling in order to establish title and access for the City and to establish the Carl and June Bender as owner’s of the property where their garage, driveway and yard are located.
Kerns said if the City does move forward with filing an adverse possession claim in Fourth Judicial District Court and the City and the Bender’s are successful, the City and the Benders will be awarded ownership of the Lane. The Council, at their upcoming meeting Monday night will be considering approval of the representation agreement to move forward with the legal action.
