Montana Woman Receives Split-Sentence for Drug Charge

A 32-year-old Roundup, Montana woman received a split-sentence in Fourth Judicial District Court in Sheridan Tuesday. District Court Judge John Fenn allowed the prosecution to withdraw from the plea agreement that was reached with defendant Brandi Davitt last November due to the fact that she failed to show up for a sentencing hearing in January, and the subsequent rescheduled hearing in February.

For the charge of Unlawful Possession of a Controlled Substance- Amphetamine, Judge Fenn sentenced Davitt to 2 to 5 years in prison, suspended in lieu of a 62-day split-sentence and three years of supervised probation.  She was given 55-days of credit for time served and ordered to pay $800 in various court costs and attorney fees. Davitt must also schedule and complete a substance abuse evaluation upon her release from jail. Davitt was arrested last year on May 6 when she was a passenger in a vehicle that had been pulled over by law enforcement for a traffic violation in Sheridan County. Davitt was placed under arrest after she was found to be in possession of drugs following a search of the vehicle.
