Born Alive Infant Protection Act Voted Down In Montana

Montana voters recently defeated a legislative referendum, that would’ve punished medical professionals, who did not take medically appropriate and reasonable actions with infants born prematurely or survived an abortion attempt.

More than 52% of Montana voters said no to referendum 131, also referred to as the Born Alive Infant Protection Act.

The measure declared a fetus or an embryo as a legal person with right to medical care.

Many of those in the medical field claimed the referendum was government overreach and intrudes on decisions made between patient and provider.

If the infant had no chance of survival, some doctors did not want the pressure of performing a painful surgery on the infant, only for the procedure to not work, and then the parents could miss out on the final moments with their newborn.
